Will Contests

A Will Contest occurs when one party challenges the validity of a will after the passing of a loved one. Sometimes Will Contests are filed because the writer of the will suffered from a cognitive or medical problem that caused them to write a will differently than they would not have otherwise. Other times, Will Contests are filed because an unscrupulous person has improperly swayed the will writer's mind in order to cause them to rewrite their will to leave that unscrupulous person substantially more money or property. Unfortunately, Will Contests are also sometimes filed for no reason at all other than anger or extortion.

A Breach of Fiduciary duty claim is filed when an executor, trustee, or other person has taken advantage of their position to benefit themselves, such as when an executor unlawfully takes money from an estate before it is split up amongst the heirs.

Texas law forbids that kind of conduct and provides a powerful legal framework built to compensate those harmed by such wrongful conduct.
